On December 15, the Ningbo Port Area Special Rectification Coordination Group for Illegal Export of Fireworks and Firecrackers (hereinafter referred to as the Coordination Group) announced that since 2022, the Ningbo Port Area has destroyed a total of 20 containers of illegally exported fireworks and firecrackers, and 12 people have been sentenced to fixed-term imprisonment for smuggling fireworks and firecrackers, effectively curbing the high incidence of illegal exports of fireworks and firecrackers.
At the end of 2021, the Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security and ten other departments jointly issued the "Opinions on the Legal Punishment of Crimes Involving Firearms, Ammunition, Explosives, and Flammable and Explosive Dangerous Goods", which clarified the criminal illegality of illegal export of fireworks and firecrackers from ports.
The coordination group organized Ningbo's transportation, customs, maritime and other relevant departments to strengthen coordination and contact with public security, procuratorial and judicial organs, and further refined and reached a consensus on severe crackdowns in accordance with the law in terms of the criminal composition, evidence specifications, identification methods and evidence collection requirements of illegal export of fireworks and firecrackers.
It is understood that in 2022, the Ningbo Public Security Department has criminally detained one person, released four people on bail pending trial, arrested 14 people, and transferred four people for prosecution. Twelve defendants endangered public security by dangerous means and were sentenced to fixed-term imprisonment ranging from one to four years.
According to the relevant person in charge of the coordination group, since the Ningbo Public Security, Transportation, Customs, Maritime Affairs and other departments signed the "Memorandum of Law Enforcement Cooperation", a consensus has been reached on on-site disposal, classification processing, clue transmission and communication and cooperation, and the joint efforts of multiple parties to rectify the illegal export of fireworks and firecrackers have achieved certain results.
Since 2022, Ningbo Customs has seized 7 containers of fireworks and firecrackers, investigated and dealt with 1 administrative case, and imposed a fine of more than 39,000 yuan; Ningbo Transportation Bureau seized 8 related cases and imposed a fine of 890,000 yuan; Ningbo Customs investigated 2 cases of evading commercial inspection and seized 2 criminal suspects.
In 2022, the coordination group launched a wartime destruction mode for illegally exported fireworks and firecrackers at the port, and took timely destruction measures for illegally exported fireworks and firecrackers seized in the Ningbo port area, quickly eliminating hidden risks and ensuring continued safety and stability in the port area.
According to statistics, in 2022, a total of three centralized destruction operations were organized, with more than 1,200 police officers dispatched; 20 containers of illegally exported fireworks and firecrackers were destroyed, including 17,818 boxes of fireworks and firecrackers, 1,454 boxes and 175,824 hand-held flame signals, and 47 boxes and 890 fireworks shells.
In addition, in order to strengthen the source management of illegally exported fireworks and firecrackers, the Ningbo Public Security Department has empowered with digital technology and steadily promoted the application of digital model scenarios for early warning of fireworks and firecrackers and dangerous vehicles, further enhancing the ability to discover and manage crimes outside the Ningbo port area.
In 2022, the model has accumulated 7,369 warning information, screened out more than 20 pieces of suspicious vehicle information, obtained 16 case clues, and successfully uncovered one case of illegal transportation of dangerous goods.
It is understood that my country's fireworks and firecrackers production accounts for about 90% of the world's total, and about 100,000 containers are sold around the world each year, of which 98% are shipped through ports and exported to the world by sea. However, currently only a few ports in China, such as Shanghai and Beihai, allow the export of fireworks and firecrackers.
As the market demand is far from being met, some cargo owners, freight forwarders and buyers take risks under the temptation of profit and choose to smuggle goods by anonymizing or making false reports.
