Measures for the Supervision and Administration of Universal Postal Service

Measures for the Supervision and Administration of Universal Postal Service

Chapter I General Provisions

Article 1 These Measures are formulated in accordance with the Postal Law of the People's Republic of China and relevant laws and administrative regulations in order to safeguard universal postal service, strengthen supervision and administration of universal postal service, protect the legitimate rights and interests of users and postal enterprises, and promote the healthy development of universal postal service.

Article 2 These Measures apply to universal postal service and its guarantee, supervision and administration within the territory of the People's Republic of China.

The postal universal service referred to in these Measures refers to the postal service provided continuously to all users within the territory of the People's Republic of China at reasonable rates in accordance with the business scope and service standards prescribed by the State.

Article 3 Postal universal service is a basic national public service and should be included in the national economic and social development plan and the urban and rural public service system, and maintain synchronous development with the economy and society.

 Article 4 Postal enterprises shall assume the obligation to provide universal postal services in accordance with national regulations.

Postal enterprises should strengthen the quality management of postal universal service, improve security measures, and ensure the effective fulfillment of postal universal service obligations; based on economic and social development and people's living needs, they should innovate service methods, enhance service capabilities, and gradually improve service levels.

The fifth The postal administration department of the State Council is responsible for supervising and managing universal postal services across the country.

The postal administrations of provinces, autonomous regions, and municipalities directly under the central government are responsible for supervising and managing universal postal services in their respective administrative areas.

Postal administration agencies below the provincial level established in accordance with the provisions of the State Council are responsible for supervising and managing universal postal services within their jurisdictions.

The postal administration department of the State Council, the postal administration agencies of provinces, autonomous regions, and municipalities directly under the Central Government, and the postal administration agencies below the provincial level (hereinafter collectively referred to as the postal administration departments) shall implement supervision and management of postal universal service in accordance with the principles of openness, fairness, and impartiality.

  Article 6 The postal network, which consists of postal facilities that provide universal postal services, is an important national communications infrastructure.

The state supports postal enterprises in giving full play to the public service role of the postal network, improving the efficiency of postal network resource utilization, and meeting the society’s multiple postal needs.

Chapter II Service Guarantee

Article 7 The postal administration department shall promote the establishment of a postal universal service system covering urban and rural areas, and advance the establishment and improvement of a postal universal service guarantee mechanism.

eighth The postal administration department shall formulate the layout and construction plan of postal facilities in accordance with the economic and social development and people's living needs, and promote the local people's governments at all levels to incorporate them into urban and rural planning. The postal administration department shall fully listen to the opinions of postal enterprises when formulating the layout and construction plan of postal facilities.

The layout and construction of postal facilities shall comply with relevant laws, regulations and standards and meet the needs of postal universal service and supervision and management.

Article 9 If the land for postal facilities that provide universal postal services is in compliance with the national land allocation catalogue, it shall be allocated in accordance with the law; and relevant fees such as supporting urban infrastructure construction shall be reduced or exempted in accordance with the law.

When constructing new urban areas, independent industrial and mining areas, development zones, commercial areas, tourist areas, residential areas, or renovating old urban areas, postal facilities providing universal postal services should be built at the same time, and should be planned, designed, constructed, and accepted in a unified manner with the construction projects.

Article 10 The establishment of postal facilities such as postal business premises, mail processing places and postboxes that provide universal postal service shall comply with the layout and construction plan of postal facilities and the standards for universal postal service.

Larger stations, airports, ports, colleges and universities and hotels should set up postal business premises to provide universal postal services; relevant units should provide convenience and necessary support in terms of venues, equipment and personnel.

Postal business premises providing universal postal services shall be set up in the location of township people's governments.

 Article 11 The design and construction of mail processing sites shall comply with the requirements for national security agencies and customs to perform their duties in accordance with the law.

 Article 12 If postal business premises or mail processing premises are expropriated, the urban and rural planning department shall make proper arrangements for the re-setting up of postal business premises or mail processing premises in accordance with the requirements of ensuring universal postal services; expropriation shall not be carried out before proper arrangements are made.

Before re-planning postal business premises or mail processing premises, the collection unit shall seek the opinions of the postal enterprise and cooperate with the postal enterprise to take measures to ensure the normal operation of universal postal services.

 Article 13 Facilities for receiving mail include mailboxes, parcel lockers, and places for receiving mail such as mail rooms and village post offices.

Government agencies, enterprises, public institutions, commercial office buildings and other places should set up mail rooms or other places to receive mail at the main entrances and exits on the ground floor of the building to provide convenient conditions such as places for installing postal parcel cabinets. Residential buildings in residential areas should have mailboxes on the ground floor. If residential buildings do not have mailboxes, residential areas should set up mail rooms or other places to receive mail. If units and residential areas do not have mailboxes, mail rooms and other places to receive mail, their property service companies or security departments (communication rooms) are responsible for receiving mail delivered by postal enterprises.

Rural areas should gradually set up village post offices or other places for receiving mail. If there are no fixed mail receiving places, the villagers' committee of each administrative village will receive mail on behalf of the government.

Postal enterprises may sign delivery agreements with units and residential communities that have mail rooms or other places to receive mail, clarifying their obligations to receive and deliver mail.

 Article 14 The design, production, installation and acceptance of mailboxes shall comply with relevant standards. After the completion of the project, the construction unit shall organize the acceptance in accordance with the statutory acceptance procedures, and unqualified projects shall be rectified in a timely manner. The postal administration department shall require postal enterprises to participate in the acceptance of the installation of mailboxes.

The property owner or management unit is responsible for the maintenance and replacement of mailboxes.

If an existing urban residential building does not have letterboxes, the postal administration department shall order the property owner or the property service company entrusted by the property owner to build them within a time limit; if the problem is not corrected within the time limit, the postal administration department shall designate other units to install letterboxes, and the necessary expenses shall be borne by the property owner of the residential building.

 Article 15 No unit or individual may damage postal facilities or affect the normal use of postal facilities.

The property rights holders of postal facilities shall carry out regular maintenance of the facilities to ensure their normal use; postal enterprises shall ensure the normal operation of fixed self-owned postal business premises in townships that provide universal postal services.

If a postal business premises is rented out or its use is changed in other ways, the postal enterprise shall, within 20 days from the date of change of use, file a record with the postal administration agency at or below the provincial level where the postal business premises is located.

  Article 16 Funds for the construction of postal universal service can be raised through a variety of channels. The postal administration department shall strengthen the industry review and supervision of construction projects using fiscal funds.

Article 17 The state subsidizes postal enterprises for providing universal and special postal services, and strengthens supervision over the use of subsidy funds.

Article 18 Railway, highway, waterway, aviation and other transportation enterprises should give priority to the transportation of mail delivered by postal enterprises providing universal postal services; stations, ports and airports should arrange loading and unloading areas and entry and exit channels.

Article 19 Vehicles providing universal postal services must carry special postal signs.

Article 20 The letter delivery business within the scope specified by the State Council shall be exclusively operated by postal enterprises.

Express delivery companies are not allowed to operate the letter delivery business which is exclusively operated by postal enterprises, nor are they allowed to deliver official documents of state organs.

 Article 21 Foreign businesses and overseas postal services are not allowed to provide postal services within the territory of the People's Republic of China.

No unit or individual may provide production and operation sites, transportation, storage and other conditions for acts that violate the first paragraph of this article.

Chapter III Service Standards

Article 22 Postal enterprises shall provide universal postal services for the delivery of letters, printed materials with a single piece weight not exceeding 5 kilograms, parcels with a single piece weight not exceeding 10 kilograms, and postal remittances.

Article 23 Postal enterprises shall comply with the postal universal service standards when providing postal universal service.

The standards for universal postal service shall be revised in a timely manner according to the needs of social and economic development for universal postal service.

Article 24 Postal enterprises should provide users with convenient and fast universal postal services through business premises, mobile service vehicles, postboxes, etc.

Postal business premises providing universal postal services shall provide universal postal services as prescribed by the State. If the universal postal services are to be suspended or restricted, approval must be obtained from the postal administration department.

  Article 25 The production and operation organization and arrangement of postal enterprises shall be able to ensure that the mail delivery time limit complies with the postal universal service standards. The mail delivery time limit shall be announced to the public for the convenience of users.

Article 26 Postal enterprises shall standardize the names and use of their postal business premises where they provide universal postal services.

Postal business premises providing universal postal services shall provide services in accordance with the business hours prescribed by the universal postal service standards; if a postal enterprise adjusts its business hours during national statutory holidays and holidays prescribed by the provincial people's government, it shall announce it to the public three days in advance and open for business in accordance with the announced hours.

Postal enterprises shall establish and implement a mail collection and inspection system in accordance with the law, clearly and standardizedly stamp the collection and delivery date stamp and other business stamps, and provide users with receipts or invoices and other certificates in accordance with regulations.

 Article 27 Postal enterprises shall deliver mail by address delivery, user collection or other methods negotiated with users in accordance with the law.

Postal enterprises shall deliver mail at least once a day in cities, at least five times a week in township and village people's government seats, and not less than three times a week in rural areas. In remote areas with inconvenient transportation, the standards formulated by the postal administration department of the State Council shall be followed.

For mails delivered to government agencies, enterprises, institutions, commercial office buildings, etc. according to addresses, they should be delivered to their mail rooms or other places where mails are received; for residential communities with mailboxes, they should be delivered to the mailboxes; if there are no mailboxes yet, they should be delivered to the mail rooms or other places where mails are received; in rural areas, they should be delivered to village post offices and other places where mails are received.

Government agencies, enterprises, institutions, residential quarter management units, etc. should provide convenience for postal enterprises in delivering mail.

Postal enterprises will increase the frequency and depth of mail delivery based on local economic and social development.

 Article 28 Mail rooms, village post offices and other places that receive mail are responsible for protecting and forwarding mail; for mail that has been confirmed unable to be forwarded for more than one month, a note of caution should be signed and the mail should be properly kept and collected regularly by the postal enterprise.

Article 29 Postal enterprises shall return mail that cannot be delivered to the sender. Situations in which mail cannot be delivered include:

(1) The recipient's address is unclear or incorrect;

(2) The original address does not contain the recipient;

(3) The recipient's new address is unknown;

(iv) The recipient is a revoked entity and there is no entity or individual collecting the mail on its behalf;

(5) The recipient dies and has no heir or agent;

(6) The recipient refuses to accept the mail or refuses to pay the fees payable;

(VII) The recipient has not received the mail after the expiration of the mail storage period;

(VIII) Mail cannot be delivered due to other reasons.

Article 30 If mail cannot be delivered and meets any of the following conditions, it will be treated as undeliverable and cannot be returned:

(1) The sender’s address is unknown;

(2) The sender declares that the item has been abandoned;

(3) The sender refuses to accept the mail or refuses to pay the relevant fees after the mail is returned;

(IV) The mail has not been collected by the sender after the storage period has expired.

Postal enterprises shall handle mail that cannot be delivered or returned in accordance with the regulations of the postal administration department of the State Council; inbound international mail items that cannot be delivered or returned shall be handed over to the customs for handling in accordance with the provisions of the Customs Law of the People's Republic of China.

Article 31 Where a postal enterprise entrusts other units to handle postal universal service business, it shall comply with the laws, regulations, rules and provisions of the postal administration department of the State Council. The entrusted unit shall have the ability to undertake postal universal service, and the postal universal service provided shall comply with the postal universal service standards. Postal enterprises shall strengthen the service quality management of units that handle postal universal service business on their behalf, and shall be responsible for the level and quality of postal universal service within the scope of entrustment.

Article 32 Where postal enterprises use postal communications infrastructure to provide services other than universal postal services, they shall not reduce the level of universal postal services.

 Article 33 If non-postal enterprises sign a entrustment agreement with a postal enterprise to act as an agent for mail delivery business, they must abide by the laws, regulations, rules and the provisions of the State Council and the postal administration department of the State Council on the approval of operating postal communication businesses.

Article 34 Newly built government agencies, organizations, enterprises, public institutions, residential property units or property service companies shall go to the local postal enterprises to handle mail delivery registration procedures; if the unit changes its name and address, or the recipient changes its address, it shall notify the local postal enterprise in advance, and may also handle mail redirection procedures. Postal enterprises shall publish the registration location and telephone number.

If the following conditions are met, the postal enterprise shall register and arrange delivery within one week from the date of registration:

(1) Having the conditions for the passage of postal vehicles and postal service personnel;

(2) Having a uniformly compiled house number;

(3) A mailbox or place for receiving mail has been set up;

(IV) Where the registration of Chinese and foreign names is required in accordance with regulations, the formalities have been completed.

Article 35 Postal codes are compiled by postal enterprises in accordance with the compilation rules formulated by the postal administration department of the State Council. The postal administration department supervises the compilation and use of postal codes in accordance with the law.

Postal enterprises shall provide postal code query services to users free of charge at postal business premises.

Chapter 4 User Rights and Obligations

Article 36 The freedom and confidentiality of citizens' correspondence are protected by law. No organization or individual may privately open, conceal or destroy other people's mail. Unless otherwise provided by law, postal enterprises and their employees may not disclose information about users' use of postal services to any organization or individual.

 Article 37 Users have the right to choose postal services and trade fairly. Postal enterprises shall not limit or designate users to use high-rate services or bundle other products in any way.

The rate standards for postal universal service businesses that implement government guidance prices or government pricing are based on the central government's pricing catalogue and are supervised by the postal administration department in accordance with the law.

Article 38 In the process of providing universal postal services, if mail is lost, damaged or its contents are missing, the postal enterprise shall compensate the user in accordance with the provisions of the Postal Law of the People's Republic of China.

Postal enterprises shall clearly state the provisions of the first paragraph of Article 47 of the Postal Law of the People's Republic of China in notices at their business premises and on registered mail documents provided to users in a manner sufficient to attract the attention of users.

If a postal enterprise bears liability for compensation for the loss of mail, it shall compensate the user within seven days from the date on which the liability is determined.

  Article 39 After a user has sent a registered mail, he or she has the right to inquire with the postal enterprise in accordance with the provisions of the Postal Law of the People's Republic of China. The postal enterprise shall inform the user of the inquiry results within the time limit prescribed by law. If the mail is not found within the inquiry period, the postal enterprise shall compensate the user in accordance with the law.

The remitter of a postal remittance has the right to inquire with the postal enterprise in accordance with Article 50 of the Postal Law of the People's Republic of China. The postal enterprise shall inform the user of the inquiry result within the time limit prescribed by law. If the remittance is not found within the inquiry period, the postal enterprise shall refund the remittance and remittance fees to the remitter.

Article 40 If users have objections to the quality of postal universal services, they can file a complaint with the postal enterprise. The postal enterprise shall promptly and properly handle the complaints filed by users.

Article 41 If a user does not receive a response within seven days after filing a complaint with a postal enterprise, or is dissatisfied with the postal enterprise's handling and response to the complaint, or the postal enterprise's complaint channel is blocked and no one handles the complaint, the user may file a complaint with the postal administration department. The postal administration department shall set up a postal industry consumer complaint center to handle user complaints in a timely manner. For complaints involving postal enterprises, the postal administration department may require the postal enterprises to verify and handle them.

Postal enterprises shall respond within 15 days of receiving the complaint transferred by the postal administration. Postal administrations shall respond within 30 days of receiving the user's complaint.

Article 42 Users have the right to supervise the quality of universal postal services and have the right to put forward opinions and suggestions to postal enterprises for improving the quality of universal postal services.

Users have the right to report to the postal administration any violation of the provisions of these Measures and any illegal or dereliction of duty by staff of the postal administration during supervision and inspection.

Article 43 When sending mail, users must abide by laws, administrative regulations, and the provisions of the State Council and its relevant departments regarding prohibited or restricted items for sending.

When sending mail, users should clearly and accurately fill in the name, address and postal code of the recipient and sender in accordance with the mail cover writing format prescribed by the postal enterprise. For registered mail, users should also fill in the mobile phone numbers of the recipient and sender if conditions permit.

When necessary, postal enterprises may require users to open and inspect letters submitted by users, but they may not check the contents of the letters. If users refuse to open and inspect, postal enterprises will not accept or send them. For mail other than letters, postal enterprises should inspect the contents on the spot when accepting or sending. If users refuse to inspect, postal enterprises will not accept or send them.

Chapter V Supervision and Management

Article 44 The postal administration department shall supervise and manage postal universal service in accordance with the law, and incorporate such indicators as the establishment of postal business premises, operation of statutory businesses, mail delivery time limits, mail inquiry, compensation for mail losses, delivery safety, user satisfaction, and user complaint rate for providing postal universal service into the postal universal service evaluation system.

Article 45 If a postal enterprise cancels its postal business premises providing universal postal services, it must obtain approval from the postal administration department.

Where a postal enterprise applies to cancel a postal business location providing universal postal services, it shall meet the following conditions:

(1) The reasons for proposing to cancel the postal business premises providing universal postal services are sufficient and reasonable, and the application materials submitted are authentic and complete;

(2) other postal business premises providing universal postal services have been arranged within the service scope of the postal business premises that are to be closed down from providing universal postal services, or other alternative measures have been taken;

(3) After the alternative measures are adopted, the establishment of postal business premises providing universal postal services within the original service scope meets the relevant requirements of the universal postal service standards;

(iv) The alternative measures taken can ensure that the overall level of universal postal service within the original service scope will not be reduced.

Article 46 If a postal enterprise stops or limits its postal universal service business, it must obtain approval from the postal administration department. The period of suspension or limitation of postal universal service business shall generally not exceed twelve months. If it exceeds twelve months, the approval procedures must be repeated.

Where a postal enterprise applies to stop or restrict the handling of postal universal service business, it shall meet the following conditions:

(1) The reasons for stopping or restricting the handling of postal universal service are sufficient and reasonable, and the application materials submitted are true and complete;

(2) Having arranged corresponding remedial measures within the service scope that may be affected by the suspension or restriction of postal universal service;

(3) The remedial measures taken shall ensure that the postal universal service business within the affected service area can be carried out normally.

Article 47 If a postal enterprise temporarily suspends or restricts the handling of postal universal service due to force majeure or other special reasons, it shall promptly announce to the public in an appropriate form, take appropriate remedial measures, and report to the postal administration department in accordance with the regulations of the postal administration department of the State Council. The temporary suspension or restriction of postal universal service shall generally not exceed six months. If it exceeds six months, it shall be handled in accordance with the provisions of Article 46 of these Measures.

Article 48 Where a postal enterprise applies for an administrative license as provided for in these Measures, it shall, in accordance with the provisions of the postal administration department of the State Council, submit an application to the postal administration agency below the provincial level in the location where it is located by its municipal (prefectural) branch, and submit relevant materials that can prove that it meets the conditions stipulated in Articles 45 and 46 of these Measures. Upon receipt of the application materials, the postal administration agency below the provincial level shall review the materials and make a decision to accept or reject the application in accordance with relevant regulations. After accepting the application, the postal administration agency below the provincial level shall conduct an on-site inspection. If it believes that a hearing is required due to major public interests, it shall announce it to the public and hold a hearing.

Postal administration agencies below the provincial level shall make an administrative licensing decision within 20 working days from the date of accepting the application. If a decision cannot be made within 20 working days, it may be extended by 10 working days with the approval of the head of the agency, and the applicant shall be informed of the reasons for the extension. However, if there are other provisions in laws and regulations, they shall be followed.

After the postal administration agencies below the provincial level make a decision to grant or deny an administrative license, they shall report it to the postal administration agencies of the province, autonomous region or municipality directly under the central government for record within ten working days. After receiving the decision to grant an administrative license, the postal enterprise shall announce it to the public in accordance with the regulations.

Postal administration agencies below the provincial level shall review the implementation of administrative licensing decisions made in accordance with Articles 45 and 46 of these Measures.

 Article 49 Postal enterprises shall file the following matters in accordance with the regulations of the postal administration department of the State Council:

(1) Setting up postal business premises;

(2) To cancel any postal business premises other than those providing universal postal services;

(3) There is a change in important filing information such as the name and business hours of the postal business premises providing universal postal services.

Article 50 Postal enterprises shall connect the basic information of motor vehicles with postal special signs to the information management system of the postal administration department through the information system. In the event of the addition, renewal and scrapping of motor vehicles, postal enterprises shall carry out system maintenance and submit reports before the end of the next month.

Postal enterprises should install driving recorders on vehicles with special postal signs in accordance with national standards.

Postal enterprises shall not use vehicles with special postal signs to engage in business activities other than mail delivery, or allow other units or individuals to use vehicles with special postal signs by leasing or other means.

Article 51 Postal enterprises shall strengthen the safety management of mails. If any of the following circumstances occur, they shall promptly report to the local postal administration department and properly handle the matter to reduce damage:

(1) If more than 100 pieces of mail are stolen, illegally detained, falsely claimed, privately opened, concealed, destroyed, lost or damaged, the problem shall be reported to the postal administration agency at or below the provincial level where the incident occurred within 48 hours; if the number is less than 100 pieces, the problem shall be included in the self-inspection report and submitted on time;

(2) If the mail backlog exceeds 1,000 pieces, the problem shall be reported to the postal administration agency at or below the provincial level where the problem occurred within 24 hours;

(3) If a criminal case is filed for investigation due to intentional delay in the delivery of mail, the person shall report the incident to the postal administration agency at or below the provincial level where the incident occurred within three days.

 Article 52 Postal administration staff may take the following supervisory and inspection measures in accordance with the law when performing their supervisory and management duties:

(1) Entering a postal enterprise or other place where activities suspected of violating these Measures are taking place to conduct on-site inspections;

(2) Obtain information from relevant units and individuals;

(3) Review and copy relevant documents, materials and vouchers;

(iv) With the approval of the head of the postal administration department, seal up the places related to activities that violate these Measures, seize the means of transport and related items used in activities that violate these Measures, and open and inspect mail other than letters that are suspected of carrying prohibited or restricted items.

Article 53 Postal administration staff shall conduct supervision and inspection in strict accordance with legal procedures. When conducting supervision and inspection, they shall show their law enforcement certificates and two or more staff members shall conduct the inspection together. Relevant units and individuals shall cooperate and shall not refuse or obstruct.

Postal administration staff have the obligation to keep confidential the commercial secrets learned during supervision and inspection.

 Article 54 The postal administration department may require postal enterprises to provide relevant cost data and other relevant information on postal universal service business according to the needs of postal universal service supervision and management. Postal enterprises shall establish and improve the self-inspection mechanism for the quality of postal universal service. Provincial postal enterprises shall submit the self-inspection results to the postal administration agencies of provinces, autonomous regions and municipalities directly under the Central Government in July of each year and January of the following year. China Post Group Corporation shall submit the self-inspection results of the national postal universal service quality in the previous year to the postal administration department of the State Council in March of each year.

Postal enterprises shall strengthen the statistics and collection of data and information on postal universal service, provide relevant data and information on postal universal service on time according to the requirements of the postal administration department, and connect to the information management system of the postal administration department of the State Council in accordance with the regulations of the postal administration department of the State Council.

Article 55 The postal administration department of the State Council and the postal administration agencies of provinces, autonomous regions, and municipalities directly under the Central Government shall regularly prepare postal universal service supervision and management reports and make them public.

Chapter VI Legal Liability

Article 56 Any violation of Article 33 of these Measures shall be ordered by the postal administration department to make corrections and may be fined up to RMB 10,000 yuan; if the circumstances are serious, a fine of not less than RMB 10,000 yuan but not more than RMB 30,000 yuan shall be imposed.

Article 57 If a foreign business provides postal services within the territory of the People's Republic of China, or if any unit or individual provides production and operation sites, transportation, storage and other conditions for a foreign business that violates the provisions of the first paragraph of Article 21, the postal administration department shall order it to correct the violation and may impose a fine of not more than RMB 20,000 yuan; if the circumstances are serious, a fine of not less than RMB 20,000 yuan but not more than RMB 30,000 yuan shall be imposed.

Article 58 Anyone who violates the provisions of Article 47, Article 50, Article 51 and Article 54 of these Measures and fails to submit relevant materials and information on time and truthfully as required by the postal administration department of the State Council shall be ordered by the postal administration department to correct the violation within a time limit and may be given a warning; if the violation is not corrected within the time limit, a fine of not less than RMB 3,000 yuan but not more than RMB 10,000 yuan shall be imposed.

Article 59 Any person who violates the provisions of Article 49 of these Measures and fails to file records on time and truthfully as required by the postal administration department of the State Council shall be ordered by the postal administration department to correct the violation within a time limit and may be given a warning; if the violation is not corrected within the time limit, a fine of not less than RMB 3,000 yuan but not more than RMB 10,000 yuan shall be imposed.

Article 60 If employees of a postal enterprise use vehicles or vessels with special postal signs to engage in activities other than mail delivery, the postal enterprise shall order them to correct their behavior, impose penalties on them, and report the results of the handling to the postal administration department within thirty days from the date of completion of the case.

Article 61 Anyone who refuses or obstructs the postal administration from carrying out supervision, inspection and investigation, or fails to respond to user complaints transferred by the postal administration in a timely manner or gives a false response, shall be ordered by the postal administration to make corrections and given a warning; if the correction is not made within the prescribed time limit, a fine of not less than RMB 3,000 yuan but not more than RMB 10,000 yuan shall be imposed.

Article 62 If the construction unit of a newly built, rebuilt or expanded residential area or residential building project fails to install letterboxes in accordance with the standards prescribed by the state, the postal administration department shall order it to correct the problem within a time limit; if it fails to correct the problem within the time limit, the postal administration department shall designate other units to install letterboxes, and the necessary expenses shall be borne by the construction unit of the residential building, and a fine of not less than RMB 10,000 yuan but not more than RMB 30,000 yuan may be imposed.

Article 63 If staff of the postal administration department abuse their power, neglect their duties, or engage in malpractice for personal gain in the course of supervision and management, and are suspected of committing a crime, they shall be transferred to judicial authorities for handling in accordance with the law; if they do not constitute a crime, they shall be given administrative sanctions in accordance with the law.

Chapter VII Supplementary Provisions

Article 64 The distribution of newspapers and periodicals prescribed by the state handled by postal enterprises in accordance with state regulations, as well as special service businesses such as free delivery of ordinary letters of conscripts, reading materials for the blind and relics of revolutionary martyrs and their supervision and management shall be implemented in accordance with these Measures.

For those who use postal and telecommunication infrastructure to operate postal and telecommunication business, the provisions of Articles 25, 26, 27, 51 and 52 of these Measures may be applied to implement supervision and management.

Article 65 These Measures shall come into force on December 1, 2015. The Measures for the Supervision and Administration of Postal Universal Service (Order No. 3 of the Ministry of Transport of 2008) which came into force on September 1, 2008 shall be repealed simultaneously.
